+ the services of storage of such goods as dresses or vehicles (cl.39);
+ the services related with the colored one of fabrics or clothes (cl.40).


CLASS 38
Telecommunications.

Explanatory note

The class 38 understand the services that allow to a person at least essentially to communicate with another for a half sensorial one. In these services those are included that:
1) they allow a person to converse with other,
2) they transmit messages of a person to other, and
3) they put to a person in oral or visual communication with other (radio and television).

This class understands mainly:
+ the services that consist essentially on the diffusion of radio programs or of television.

This class doesn't understand, in particular:
+ the services of publicity for radio (cl. 35).


CLASS 39
Transport; packing and storage of goods; organization of trips.

Explanatory note
The class 39 understand the services rendered essentially transporting people or goods of a place to other (for railroad, highway, dilutes, air or pipeline) and the services necessarily related with those transports, as well as the services related with the deposit of goods in a warehouse or in another building with a view to their preservation or it guards.

This class understands mainly:
+ the services rendered for companies that exploit stations, bridges, ferries (ferries), etc. used by the transport one;
+ the services related with the rent of vehicles of transport;
+ the services related with the marine tow, the discharge, the operation of ports and of jetties and the salvage of ships in danger and of their shipments;
+ the services related with the operation of the airports;
+ the services related with the packing and packaging of goods before its expedition;
+ the services that consist on relating informations to the trips or the transports of goods for middlemen and agencies of tourism, relative informations to the rates, the schedules and the means of transport;
+ the relative services to the inspection of vehicles or of goods before the transport.

This class doesn't understand, in particular:
+ the relative services to the publicity of the companies of transport, such as the distribution of handouts or the publicity for radio (cl.35);
+ the services related with the emission of trip checks or of bills of credit for middlemen or travel agencies (cl.36);
+ the relative services to the insurance (commercial, of fire or of life) during the transport of people or of goods (cl.36);
+ the services rendered for the maintenance and the repair of vehicles, but not the one maintenance neither the repair of objects in connection with the transport of people and of goods (cl.37);
+ the services related with the reservation of hotel rooms for the travel agencies or for middlemen (cl.42).


CLASS 40
Treatment of materials.

Explanatory note

The class 40 understand the services essentially, not enumerated in other classes, borrowed for the treatment or the mechanical transformation or chemistry of inorganic or organic substances or of objects.
For necessities of the classification, the mark is considered like a mark of service only in the cases in that the treatment or the transformation are made by another person's bill.
For identical necessities of the classification, the mark is considered like a factory mark in all the other cases in that the substance or the object is marketed by that that has treated her or transformed.

This class understands mainly:
+ the services related with the transformation of an object or of a substance and everything
treatment that implies a modification of their essential estates (for example, the one colored of a dress); a maintenance service, although it is usually understood in the class 37, it will be classified in consequence in the class 40, if it implies happiness modification (for example, the one chromed of the fender of an automobile);
+ the services of treatment of materials that can intervene in the course of the production of a substance or of an object anyone that is not a building; for example, the services that they refer to the cut, to the factory, to the polish for abrasion or to the lining metallic.

This class doesn't understand, in particular:
+ the repair services (cl.37).


CLASS 41
Education; formation; esparcimiento; sport and cultural activities.

Explanatory note

The class 41 understand the services rendered essentially for people or for institutions to develop the mental abilities of people or animals, as well as the services dedicated to to have a good time or to entertain.

This class understands mainly:
+ the services of individuals' education or of taming of animals, under all their forms;
+ the services whose essential end is the entertainment, the amusement or the recess of those
individuals.

 

CLASS 42
Scientific and technological services as well as investigation services and design relatives to them;
analysis services and of industrial investigation; I design and development of computers and software; Juridical services.

Explanatory note
The class 42 understand the services rendered essentially for people, to individual title or collective, in connection with theoretical or practical aspects of complex sectors of activities; such
services are lent by representatives of professions like physical chemists, engineers, specialists in computer science, jurists, etc.

This class understands mainly:
+ the services of engineers that take charge of evaluations, estimates, investigation and inform in the fields scientist and technological;
+ the services of scientific investigation with ends doctors.

This class doesn't understand, in particular:
+ the investigations and evaluations in commercial matters (cl.35)
+ the services of word processing and of administration of computer files (cl.35);
+ the evaluations in financial and fiscal matter (cl.36);
+ the services of mining extraction and oil company (cl .37);
+ the installation services and repair of computers (cl. 37)
+ the services rendered for representatives of such professions as doctors, veterinarians, psychoanalysts (cl.44)
+ the services of medical treatments (cl.44)
+ the services rendered for gardeners paisajistas (cl.44)


CLASS 43
Restoration services (feeding) Temporary lodging.

Explanatory note
The class 43 understand the services rendered essentially for people or establishments whose end
it is to prepare allowances and drinks for the consumption as well as the services rendered offering the one lodging, the housing and the food in hotels, pensions or other establishments that assure a
temporary lodging.

This class understands mainly:
+ the standby services of lodging for travelers, borrowed mainly for agencies of  travel or corridors;
+ the residences for animals.

This class doesn't understand in particular:
+ the services of personal assets rent like houses, apartments, etc. dedicated to an use permanent (cl. 36);
+ the services of organization of trips lent by agencies of tourism (cl. 39);
+ the services of conservation of allowances and drinks (cl. 40):
+ the services of discotheque (cl. 41);
+ the schools for pupils (cl. 41);
+ the houses of rest and convalescence (cl. 44).


CLASS 44
Medical services; Veterinary services; Cares of hygiene and of beauty for people or animals;
Agriculture services, horticulture and forestry.

Explanatory note
The class 44 understand the medical cares essentially, of corporal hygiene and of beauty lent by people or establishments to people or animals; he/she understands the services equally related with the sectors of the agriculture, horticulture and forestry.

This class understands mainly:
+ the services of medical analysis related with the treatment of people (such as radiological exams and you take of blood);
+ the services of artificial insemination;
+ the consultations as regards pharmacy;
+ the breeding of animals;
+ the services related with the cultivation of such plants as the gardening; the services related with the such floral art as the floral composition as well as the services rendered for gardeners landscapes.

This class doesn't understand in particular:
+ the services of destruction of harmful animals (that are not of those of agriculture, horticulture and forestry) (cl. 37);
+ the installation services and repair of watering devices (cl. 37);
+ the services of transport in ambulanc0e (cl. 39)
+ the services of slaughterhouse of animals and of taxidermy (cl. 40);
+ the pruning services and sawed wooden (cl 40);
+ the services of training of animals (cl. 41);
+ the services rendered for gyms (cl. 41);
+ the services of scientific investigation with ends doctors (cl. 42);
+ pensioners for animals;
+ the residences for grown-ups (cl. 43).


CLASS 45
Personal and social services lent by third dedicated to satisfy necessities of individuals; safe-deposit services for the protection of goods and of people.

Explanatory note
This class understands mainly:
+ The investigation services and surveillance relatives to the security of people and of entities;
+ The services rendered to people in connection with such social events as services of accompaniment in society, matrimonial agencies, funeral services.

This class doesn't understand in particular:
+ The professional services that you/they lend a direct help to the operations or functions of one
commercial enterprise (cl. 35)
+ The services related with financial or monetary business and the services related with the insurance (cl. 36);
+ The services of travelers' accompaniment (cl. 39);
+ The services of armored transport (cl. 39);
+ The services of people's education, under anyone in their ways (clc. 41);
+ The services of singers or of dancers (cl. 41);
+ The juridical services (cl. 42);
+ The services rendered for third that assure cares doctors, of hygiene and of beauty for people or animals (cl. 44);
+ Some rent services (consult the alphabetical list of services and the note general b) relative to the classification of services.
